Is drink or drunk driving considered a Criminal Offence

A criminal offence ( a crime) is a type of wrong doing that breaches the sensibilities of the society as a whole.  Hurt and harm whether it be emotional or physical is inflicted on the victims.  The behaviour violates the social moral standards.

Generically the traffic offence in Singapore is not considered a crime, however, things are not as simple as it seems.  If you use a vehicle as a weapon to carry out a well thought murder it could become a crime.  Other things like speeding, parking at the wrong places should not constitute an offence under your records.

A person will have his records shown on the register if:

  • He is convicted of registered crimes in Singapore.
  • He was called to be banished, expelled or deported from Singapore OR Malaysia.
  • Convicted or ordered to be banished, expelled, or deported from anywhere outside of Singapore and Malaysia.  This is especially so with particulars provided by the relevant officers or authorities of such a place.

For Drink and Drunk driving cases, the situation is different.  It should not constitute as an offence that can be registered.  But if you have hurt or murdered someone using the vehicle then the situation will be different.  If found guilty and intentional.  Then the offender might have a registered offence under his records.
